1. Acceptance of Terms

By accessing the Mars Estate website, creating an account, or placing an order, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use this site or our services. Mars Estate reserves the right to update these Terms at any time. Continued use of the site following any changes constitutes your acceptance of the revised Terms.

2. Age Verification

You must be 21 years of age or older to purchase wine from Mars Estate. By creating an account or placing an order, you represent and warrant that you are of legal drinking age in your jurisdiction. An adult signature (21+) is required upon delivery. Mars Estate is not responsible for failed delivery attempts due to the absence of an eligible adult recipient.

3. Eligibility & Allocation Membership

Mars Estate wines are offered exclusively through a member allocation program. Membership is granted at the sole discretion of Mars Estate and does not constitute a guarantee of allocation in any current or future offering. Mars Estate reserves the right to approve, limit, suspend, or terminate membership at any time and for any reason without prior notice. Allocation memberships are personal and non-transferable.

4. Legal Compliance for Wine Shipments

Direct-to-consumer wine shipping is regulated on a state-by-state basis. It is your responsibility to confirm that receiving wine shipments from a California winery is legal in your state and locality before placing an order. Mars Estate ships only to states where direct-to-consumer shipments are permitted under applicable law. Mars Estate will not be held liable for orders placed to jurisdictions where DTC wine shipping is prohibited.

5. Orders, Pricing & Payment

All prices are listed in US dollars and are subject to change without notice. Placing an order constitutes your agreement to pay the price displayed at the time of purchase, plus applicable taxes and shipping fees. Mars Estate reserves the right to cancel or limit any order at its discretion. We accept major credit cards; by providing payment information, you authorize Mars Estate to charge the full amount at the time of order confirmation.

6. All Sales Final

All wine sales are final. Mars Estate does not accept returns or issue refunds. If your order arrives damaged or with a quality defect, please contact us at info@marsestates.com within 7 days of delivery with your order number and photographs of the damaged items. Mars Estate will evaluate each claim on a case-by-case basis and, at its discretion, may offer a replacement, store credit, or other resolution.

7. Shipping, Delivery & Risk of Loss

Risk of loss and title for wine purchased from Mars Estate transfers to you at the point of carrier pickup. Mars Estate is not responsible for delays, losses, or damage caused by the carrier once a shipment has been tendered. Estimated delivery timelines are provided for informational purposes only and are not guaranteed.

8. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify Mars Estate immediately at membership@marsestates.com if you suspect unauthorized use of your account. Mars Estate is not liable for any loss or damage arising from your failure to protect your account information.

9. Intellectual Property

All content on the Mars Estate website — including text, images, logos, design elements, and copy — is the exclusive property of Mars Estate and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content from this site without prior written permission from Mars Estate.

10. Disclaimer of Warranties

Mars Estate's website and services are provided "as is" without warranties of any kind, express or implied. Wine is a perishable agricultural product subject to variation. Mars Estate makes no warranty that any particular wine will meet your expectations of quality, flavor, or character.

11. Limitation of Liability

To the maximum extent permitted by law, Mars Estate's total liability to you for any claim arising out of or relating to these Terms or your use of our services shall not exceed the total amount paid by you to Mars Estate in the twelve (12) months preceding the claim. Mars Estate shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

12. Indemnification

You agree to indemnify and hold harmless Mars Estate, its owners, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of our services, your violation of these Terms, or your violation of any applicable law.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Napa County, California. You waive any objection to such jurisdiction and venue.

Excessive or irresponsible consumption of alcohol may have personal, social or health consequences. As part of its commitment to responsible consumption, we ensure that communications regarding our products do not show or encourage excessive consumption or misuse of any kind. We are committed to promoting the responsible advertising of our products and encouraging improved advertising standards for the industry as a whole.
